مجازات مرگ يا حبس ابد بدون امكان آزادي، نبايد در مورد جرمهايي كه اشخاص زير 18 سال مرتكب مي شوند اعمال گردد. در نتیجه صدور حكم به سلب حيات ( قصاص نفس ) موکل كه در هنگام وقوع جرم پانزده سال داشت بر خلاف صريح قانون بوده و دادنامه هاي صادره از اين حيث مخدوش است.
