Genocide is the deliberate and systematic destruction, in whole or in part, of an ethnic, racial, religious, or national group. Under international law, genocide is declared as a crime whether committed in time of peace or of war.

Today, genocide is increasingly seen as part of human rights and humanitarian law. The International Criminal Court, as a permanent tribunal (please see below for more information), prosecutes individuals for genocide, crimes against humanity, war crimes, and the crimes of aggression. The individual perpetrator will be punished ‘whether they are constitutionally responsible rulers, public officials, or private individuals’.

Article 6 of the International Criminal Court Statute defines genocide as such:

* Killing members of the group;
* Causing serious bodily or mental harm to members of the group;
* Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
* Imposing measures intended to prevent births within the group;
* Forcefully transferring children of the group to another group.

نسل کشی نقض آشکار یا دسته جمعی حقوق بشر میباشد.

نسل کشی از بین بردن عمدی یا دسته جمعی کل یا بخشی از یک گروه قومی ، نژادی، مذهبی یا ملی میباشد. طبق قوانین بین المللی، نسل کشی چه در زمان جنگ و چه در زمان صلح،جرم قلمداد گردیده است.

امروزه نسل کشی بصورت فزاینده بعنوان بخشی از حقوق بشر و قوانین بشردوستانه دیده میشود. دادگاه جنائی بین الملل بعنوان یک دادگاه دائمی (جهت اطلاعات بیشتر رجوع شود به ذیل صفحه) تک تک افراد را برای نسل کشی، جنایت علیه بشریت، جنایات جنگی و جنایات تجاوزگری، تعقیب و محاکمه مینماید. فرد مرتکب را چه اساسا افراد مسئول، حاکم، مقامات دولتی یا افراد شخصی باشند، مجازات خواهد نمود.

ماده 6 دادگاه جنائی بین المللی مصادیق نسل کشی را بشرح زیر تعریف مینماید :

الف) کشتن اعضای گروه

ب) وارد آوردن آسیب جدی جسمانی یا روحی به اعضای گروه

ج) ضربه عمدی بر شرایط زندگی گروه با هدف زوال بخش یا کلی جسمانی.

د) تحمیل تدابیر عامدانه در جلوگیری از تولد جدید در گروه

ه) انتقال اجباری بچه های گروه به گروه دیگر.
