وقتی قانون جنایت می‌آفریند

آمنه بهرامی‌ نوا، زن جوانی است كه در شرایط سخت ایران توانسته است تحصیلات دانشگاهی خود را در رشته الكترونیك به پایان برساند و مشغول كار شود و با هزاران امید و آرزو به آینده خود بیندیشد. این آینده، اما، با حركت جنایتكارانه مرد جوانی كه ادعای دوستی او را داشته یكباره به هم می‌ریزد. این مرد خواهان ازدواج با آمنه بوده، ولی آمنه خواست او را رد می‌كند. مرد جوان به جای این كه با پاسخ «نه» آمنه راه خود را در پیش گیرد و برود، در بعد از ظهر روزی در آبان ۱۳۸۳ بر سر راه آمنه ظاهر می‌شود و ظرف اسیدی را كه در دست داشته بر سر و روی آمنه می‌پاشد. آمنه می‌سوزد، و تا به بیمارستان برسد و چند ساعت بعد تحت معالجه قرار گیرد دو چشمش را كاملا از دست داده و چهره زیبای او كاملا به صورت وحشتناكی دگرگون شده است. آمنه برای تمام عمر خود بینایی و چهره و زندگی عادی خود را از دست داده است.

در طول چهار سال گذشته، آمنه از یك سو برای معالجه چهره‌اش در ایران و اسپانیا بارها تحت عمل قرار گرفته است و از سوی دیگر برای تعقیب و مجازات جنایتكاری كه زندگی او را به این صورت تباه كرده در نظام قضایی ایران دوندگی كرده است. او تا به حال ۱۷ عمل جراحی داشته است و هنوز نیاز به این دارد كه تحت چندین عمل جراحی دیگر قرار بگیرد. این معالجات هزینه‌‌های سنگینی در بر داشته كه با كمك افراد خیری فراهم شده و آمنه هنوز برای ادامه معالجه به كمك نیاز دارد. در دادگستری نیز او تا به حال توانسته است فرد اسیدپاش خود را سه بار به دادگاه بكشاند و او را در جایگاه متهم بنشاند. آخرین دادگاه او در هفته گذشته انجام شد و دادگاه كه متهم را مجرم تشخیص داده، قرار محكومیت او را صادر كرده است. مجید موحدی به جرم اسیدپاشی بر روی آمنه و از جمله كور كردن چشم‌های او به قصاص چشم محكوم شده است.

پدیده اسیدپاشی بر روی زنان به خصوص از سوی مردانی كه به دلایل عشقی یا ناموسی می‌خواهند انتقام بگیرند و زندگی زنی را برای ابد تباه كنند در ایران شیوع كمی ‌ندارد. این پدیده نیز، همانند سایر نابسامانی‌ها و بدهنجارهای اجتماعی و خشونت‌ها و جنایت‌های فیزیكی و جانی، در ایران تحت جمهوری اسلامی گسترش وسیع یافته است. صفحات روزنامه‌ها پر از حوادث دردناكی است كه هر روز در گوشه و كنار كشور اتفاق می‌افتد، زندان‌های ایران از متهمان به ضرب و جرح و تجاوز پر است، و آمار اعدام‌هایی كه به عنوان قصاص در ایران صورت می‌گیرد رو به فزونی است. و نظام پوسیده و فاسد حقوقی و قضایی ایران به جای این كه برای این همه خشونت و رنج و درد علاجی بیندیشد، خود به گسترش آن‌ها كمك می‌كند. قانون در ایران از ارتكاب جنایت مانع نمی‌شود و بلكه خود جنایت‌زا است.

مجید موحدی پس از ارتكاب عمل وحشیانه خود ظاهرا هیچ احساس پشیمانی نداشته و بلكه به آن افتخار می‌كرده است. در دادگاه اول، به گفته آمنه، وقتی از تصویری از او پیش از اسیدپاشی سخن به میان آمده، مجید گفته است كه آن تصویر را فراموش كنید و وضع فعلی او را ببینید كه باید تا ابد با آن زندگی كند. در مورد دیگری‌ مجید وقتی با احتمال حكم قصاص روبرو شده ظاهرا به دادگاه اعتراض كرده است كه ده‌ها نفر دیگر مرتكب چنین عملی شده‌اند و مجازات نشده‌اند و اكنون چرا او باید قصاص شود. آمنه مصمم بوده كه این فرد از مجازات فرار نكند و از سوی مردم كوچه وخیابان و در اتوبوس و مترو از او خواسته‌اند كه نگذارد مجرم از مجازات فرار كند. از این رو، آمنه از قصاص صورت و بقیه صدماتی كه دیده گذشته است ولی خواستار قصاص چشم شده ودادگاه حكم كرده است كه دو چشم مجرم با ریختن اسید كور شود - مشروط بر این كه خانم بهرامی‌ نوا مبلع ۲۰ میلیون تومان برابر با نصف دیه مرد به آقای موحدی بپردازد.

از نكته آخر می‌گذریم كه به موجب نظام حقوقی ایران، قربانی باید برای مجازات مجرم به او پول پرداخت كند. یعنی در این نظام مبتنی بر «عدل اسلامی» قربانی جریمه ‌می‌شود و مجرم پاداش نقدی می‌گیرد. در باره این جنبه وحشتناك و مسخره نظام حقوقی ایران كه تابعی از ارزش‌گذاری تبعیض‌آمیز مردم بر اساس جنسیت آنان است بارها در همین ستون سخن گفته شده است. ولی در این جا باید این نكته را كه در بالا به آن اشاره شد اضافه كرد كه خانم بهرامی نوا هنوز نیاز به معالجه دارد و حتا كوری او نیز تا حدی معلول تأخیر در جراحی و فقدان امكانات مالی است. در این شرایط او اگر بتواند پولی فراهم كند باید بیش و پیش از هرچیز به درد معالجات خود بزند، ولی نظام حقوقی ایران با سنگدلی ‌تمام به او حكم می‌كند كه اگر خواهان مجازات مجرم است چاره‌ای ندارد جز این كه پولی‌ فراهم كند و به جای ‌معالجه خود آن را به اسیدپاش بدهد.

ولی‌ چرا خانم بهرامی خواهان قصاص چشم است و به دنبال آن است كه به هر وسیله شده پولی فراهم كند تا بتواند در دو چشم آقای موحدی اسید بریزد؟ او در مصاحبه با صدای آمریكا در ۳۰ آذر به این سؤال پاسخ داده است. او می‌گوید كه خواهان خشونت نیست، و نمی‌خواهد شاهد كور شدن هیچ كسی باشد. ولی او چاره‌ای ندارد: اگر قصاص نخواهد، دادگاه حكم می‌كند كه مجرم ۲۰ میلیون تومان به عنوان دیه به خانم بهرامی بدهد و بعد مجرم آزاد می‌شود و قضیه به پایان می‌رسد. این سخن برای گویندگان صدای آمریكا به سختی باورناكردنی می‌رسد و از خانم ستوده وكیل دعاوی می‌پرسند كه آیا واقعا چنین است و اگر قصاص در كار نباشد هیح مجازات دیگری در انتظار مجرم نیست؟ خانم ستوده پاسخ می‌دهد كه اگر قاضی تشخیص دهد كه ممكن است مجرم باز مرتكب جرم شود «می‌تواند» برای او مجازات تعزیری (یعنی غیر از حد یا قصاص) تعیین كند. به مفهوم مخالف، مجرم ممكن است بدون مجازات رها شود - هم‌چنان كه در مورد قتل و جرح‌های زیادی تا به حال پیش آمده است.

به عبارت دیگر، در كشوری كه تا این حد خشونت و جنایت رواج دارد، قانون‌گذار در موارد ضرب و جرح و قتل، از سوی ‌جامعه مجازاتی برای مجرم تعیین نكرده است، و تنها قاضی می‌تواند اگر لازم تشخیص داد (جز قصاص و دیه كه در اختیار قربانی یا بستگان او است) مجرم را به زندان بفرستد. تصور این مسئله بسیار وحشتناك است. امنیت جانی و فیزیكی یكی از مهمترین دغدغه‌های یك شهروند در جامعه است، و تعرض فیزیكی به جان و حیات انسان از بزرگترین جنایات یك جامعه بشمار می‌رود. از این رو تقریبا در همه جوامع، این گونه خشونت‌ها جرم عمومی تلقی می‌شوند و جامعه برای جلوگیری از تكرار آن‌ها و تنبیه مجرمان، مجازات‌های سنگینی برای آن‌ها تعیین می‌كند. در جمهوری اسلامی، اما، این جنایات سنگین جرم خصوصی تلقی می‌شوند و مسئله رسیدگی به جنایاتی از این قبیل به حد دعاوی مالی بین افراد تقلیل می‌یابد. سرنوشت مجرم به دست قربانی یا ولی‌ دم سپرده می‌شود تا قصاص كند و یا اگر به اعمال این خشونت ضد انسانی راضی نیست عفو كند یا دیه بگیرد و بعد شاهد آزادی فوری یا قریب الوقوع مجرم باشد. جامعه هیچ مسئولیتی در قبال جنایات ضرب و جرح و قتل برای خود نمی‌شناسد و برای پیشگیری از آن‌ها و تنبیه مرتكبان آن‌ها اقدامی نمی‌كند.

اصولا از دید قانونگذار جمهوری‌ اسلامی جان و اعضای انسان هم‌چون مال و اموال او است كه اگر كسی آن را گرفت فرد می‌تواند آن را (نه البته به معنای دقیق كلمه و بلكه به صورت تقاص) بازپس بگیرد. در واقع می‌توان گفت كه از دید این قانون‌گذار تعرض به جان و اعضای انسان حتا به اندازه تعرض به مال او اهمیت ندارد. چرا كه قانون دست كم دزدی را یك جرم عمومی می‌شناسد و از این رو علاوه بر باز گرداندن اموال مسروقه به صاحب آن این عمل را مستحق مجازات سنگین و خشن بریدن دست می‌داند. ولی در مورد ضرب و جرح و قتل حتا تا این حد نیز‍ صفت مجرمابه بر آن‌ها بار نمی‌شود، و بلكه مسئله به عنوان یك امر خصوصی بین مرتكب و قربانی تلقی می‌گردد. از دید قانونگذار در جمهوری‌ اسلامی، اگر كسی مال شهروندی را بدزدد، شهروند حق دارد مالش را پس بگیرد و جامعه حق دارد دست دزد را ببرد. ولی اگر كسی به شهروندی صدمه جانی‌ بزند، قربانی (یا ولی دم او) تنها حق دارد قصاص كند یا دیه بگیرد، ولی جامعه دیگر به فرد متجاوز كاری ‌ندارد (و تنها قاضی در مواردی ممكن است او را زندانی‌ كند).

به این ترتیب، تعجبی ‌ندارد اگر در جمهوری اسلامی هم‌چنان خشونت رو به گسترش است، آمار جنایات بالا می‌رود، و مجازات‌های ضد انسانی اعدام و قطع عضو و امثال آن افزایش می‌یابد. قانونگذار جرایم سنگین اجتماعی را به حد دعاوی خصوصی تقلیل داده و قربانیان و بازماندگان آنان را بین اعمال خشونت و مبادله مالی یا گذشت مخیر كرده است. در مورد قصاص نفس، من در نوشته دیگری توضیح داده‌ام كه قانون چگونه تهی‌دستان را به كام مرگ می‌فرستد و به توانگران چك سفید‌ امضا برای قتل می‌دهد1. در این جا نیز می‌توان دید كه قانون قصاص عموما نتیجه‌ای جز افزایش خشونت و جنایت ندارد. اگر قربانی (یا ولی دم) قصاص كند خود به حد یك آدم‌كش یا ضارب تنزل كرده است. اگر دیه بگیرد جان و حیثت انسان را به ثمن بخثی فروخته است، و اگر عفو كند البته انسانیت بزرگی از خود نشان داده و گذشت زیادی كرده است. ولی در هر دو صورت اخیر، احیانا مجرم را در ارتكاب مجدد جرم جری كرده است. دست كم این كه در دو حال اخیر، مجرمان بالقوه دیگر درس و عبرتی نمی‌آموزند و احتمال تكرار فجایعی از این قبیل بیشتر می‌شود.

یعنی قانون در جمهوری اسلامی جنایت‌زا و خشونت‌زا است. این قانون یا قربانیان را وامی‌دارد كه به خشونت قصاص متوسل شوند كه خود عملی خشونت‌بار و رفتاری بی‌رحمانه، ناانسانی و اهانت‌بار است، و بنا به اصل 5 اعلامیه جهانی حقوق بشر (و ملحقات آن) كه ایران آن‌ها را امضا كرده و به آن‌ها متعهد است ارتكاب آن از سوی حكومت جرم محسوب می‌شود. یا از قربانیان می‌خواهد دیه بگیرند یا عفو كنند و بعد مجرم را غالبا در جامعه رها می‌كند تا دیگران ببینند كه می‌توان جنایت كرد و دست بالا با پرداخت مقداری پول از عواقب آن فرار كرد. در هر دو حالت، قانون به گسترش خشونت و جنایت كمك كرده است. و این قانون است كه آمنه بهرامی‌ نوا را وامی‌دارد تا بر خلاف میل قلبی خود و نفرتی كه از اعمال خشونت دارد خواهان كور كردن چشمان كسی باشد كه با جسارت فراوان و به انتظار فرار از مجازات به صورت وحشیانه‌ای بینایی او را گرفته و چهره و آینده او را برای همیشه تباه كرده است.

آمنه بهرامی‌ نوا می‌گوید كه یك احساس وظیفه سنگین اجتماعی به او حكم كرده است كه این قصاص را بخواهد. او دیده است كه مجرم چگونه در دادگاه هیچ احساس شرم و گناه یا تأسفی از خود نشان نداده و هم‌چون بسیاری از اسیدپاشان دیگر كه از مجازات فرار كرده‌اند به كار خود افتخار می‌كرده است. او از قول همه كسانی كه در كوچه و خیابان و اتوبوس و مترو وضع او را دیده‌‌اند و همدردی نشان داده‌اند نقل كرده كه از او خواسته‌اند از خواست قصاص كوتاه نیَاید. او و همه این كسان دیده‌اند و می‌دانند كه نظام حقوقی و قضایی جمهوری اسلامی این مجرمان را تعقیب و مجازات نمی‌كند و بلكه به صورت بی‌رحمانه‌ای مجازات آنان را بر دوش قربانی (یا بازماندگان او) قرار داده است. آمنه بهرامی‌ نوا راه دیگری نمی‌شناسد. او مجبور است به خاطر عدالت و انسانیت و برای جلوگیری از تكرار جرم و عبرت دیگران (كارهایی كه وظیفه جامعه است) متوسل به یك خشونت ضد انسانی شود. او احساس می‌كند كه اگر چنین نكند به گسترش جنایت‌هایی از قبیل آن چه كه بر سر خود او آمده كمك كرده است. هر دو گزینه او خشونت‌زا است و این گزینه‌های خشونت‌زا را نظام حقوقی و قضایی جمهوری اسلامی بر او تحمیل كرده است. این نظام خشونت‌زا و جنایت‌زا است - و كلید افزایش مستمر جنایت و خشونت در جمهوری اسلامی را باید در این واقعیت دید.

Unfortunately, the Islamic barbarism imposed on Iranian society is deep and multilayered. The gender segregation and its social effects are the lower priority in terms of their degree of barbarism with respect to the greater Islamic criminal enterprise. Among the highest priorities in fighting Islamism is the Ghesas law, or the Islamic bill of retribution. This is an unprecedented written-law in Iranian history that has been on the books for only the last 26-27 years. There is no room in human society for this barbarism. I am posting some excerpts of this unprecedented barbarism below (By Chandra Talpade Mohanty, Ann Russo and Lourdes Torres):

The Bill of Retribution

The following is a selection of the articles from the Bill of Retribution (Qasas) which affects women. This bill was developed and passed by the Parliament of the Islamic Republic of Iran.

Article 5: If a Muslim man willfully murders a Muslim woman, he will be sentenced to Qasas (retaliation), but the woman's guardian must pay the murderer one-half of a man's blood-money before he receives Qasas.

Article 33: Testimony: (a) A case of willful murder is proved only on the bases of two righteous men's testimony; (b) A case of semiwillful or unintentional murder is proved on the basis of the testimony of two righteous men, or of one righteous man and two righteous women, or the testimony of one righteous man and the plaintiff's oath.

Article 23: Murder requires Qasas provided the victim does not religiously deserve to be killed -- e.g., someone who swears at the Great Prophet (may Praise be Upon Him), the Chaste Imams (may Peace be Upon Them), or Saint Zahra (may Peace be Upon Her); or someone who violates one's harim (bounds) and could not be repulsed but by murder; or that the husband should see someone committing adultery with his wife, in which case it is only permissible for the husband to kill both of them. In all of the above cases it is not admissible to carry out qasas on the murderer.

There is only one solution:
Eradicate Islam !

Have anyone of you ever been to an Iranian court house? The Sharia laws can be interpreted in your favour if you are part of the IRI system! But, in the case of other poor people without moeny or any connections, it is a disaster!

This is about putting the responsibility back on shoulders of the victim!

God knows how many illiterate Mullas and civilian judges are put there to exercise the "Sharia"!
It is a barbaric way of enforcing law and order.

Well Wisher, you should move back to Iran or Saudi Arabia!

Mr. Bagherzadeh, If I'm not mistaken, you're against punishment in the form of physical disfigurement or the death penalty. Now, it seems to me that, *intuitively*, no capital punishment might not deter crime as much as *optional* capital punishment, and optional capital punishment might not deter crime as much as mandatory capital punishment. I would say that same if the word "capital" were replaced with "corporeal."

(I say "intuitively" above because I have no data to back up this guess, and my guess could very well be wrong. What deters a crime probably depends on a variety of factors, and a facile generalization could easily be wrong.)

I disagree with the idea that a harsh punishment should be mandatory in cases such acid throwing. I think judges need to be given some discretion to take special circumstances into consideration.

For example, consider a scenario where a man named 'X' rapes and kills the children of woman named 'Y'. Then lady Y takes the law into her own hand and, in revenge, throws acid in X's face.

Lady Y certainly deserves punishment, but her crime is not as heinous as the acid-throwing case discussed in your article. In such a case, a very short prison term plus a fine (blood-money) might be the appropriate response. I might even waive the prison term. After all, her children were raped and killed by that man.

So, rather than making things mandatory, it is good to leave lee-way for judges to take any extenuating circumstances into consideration. To be sure, that introduces an element of subjectivity and lack of uniformity in the application of the law. But, sadly, I don't think there is any such thing as a perfect solution in this matter. Every solution will have its draw-backs.

Iran's system has shortcomings that need to be addressed. But it seems to me that it has some positives as well. The fact that a victim can choose to reduce the punishment of the criminal seems to me a very interesting and possibly valuable feature of Iran's penal code. It makes Iran's system an interesting mixture of harshness and mercy.

The article says: If there were no sharia there were no such crimes.
There is apparent similarity between these two statements. by critical observation one sees the lack of objectivity in both of them.
The article does not expresses the whole story. How begann it? How developped that young man to wish the marriage with that girl. Were they not several times together? behind locked doors and closed curtains? hadent she let him hadent she begged him to carressing her thighs and kissing what she possesed inbetwwen? the young man was then sure that the Interesst is by bothsides. For him existed no other choice accept marriage after having spent those nice hours and lucks days together. what he has done can not be justified if there had not been any prococations and letting the first steps beeing done by the girl. Also in this case I can not justify his unexcusable action. However he will have to and he has paid with money and jailsentence. The article is written in a way as if it is the Sharia which brings the mass in these situations. It let all the crimes which happen almost secondly specially in the areas wrere Sharia is damned und put asside. Although the most crimes in the world happen just in these areas.
I mean all the young girls and young men should realize what Iranians believe since allways: CHE KHOSH BE MEHRABANI AZ DOE SSAR BE. If one side does not want let Him/Her better go. And Sharia will someday govern the universe. All likewise strugglings to defame sharia will not prevent it. better lokk arround with more objectivity and less emotions. Let's Reason More Cautiously

Mr. Bagherzadeh,

I see no convincing evidence that the Qisas law has caused an increase in crime.

Crime rates correlate with a variety of social factors. High crime rates tend to be a problem in rapidly changing societies in the throes of industrialization, demographic change, etc. with a large gap between the rich and the poor and a lack of sufficient social cohesion.

Intuitively, it seems that the threat of being blinded would DETER potential acid-throwers, not encourage them. Therefore, intuitively, I suspect you're wrong.

1400 years of retarded islamic laws have not taught these people anything ... nothing helps unless we educate ourselves that islamic laws and regulations are for people who lived in deserts of Arabia 1400 years ago and these laws do not pertain to everywhere and most importantly to today!

Educate your children, teach them respect for human being, respect for life ... and keep them away from islam.

Your point is well taken. however there is a clear difference in punishing (aka hanging) a political prisoner for his or her own view, than some one
that inflicts so much irreversable damage to some one else. All I am saying is if we had harsh laws enforced aganist men abusing women, may be it will deter most guys from doing this kind of harm, it surely won't stop all.

If there were any lessons to be learned from all the hangings, executions, hand and foot choppings, eye gougings, stonings, etc. etc. as means of punishment for various crimes in Iran since 1979, there would be no more crime or criminals left in Iran after 30 years, yet we see just the opposite, according to the mullahs' own government sponosred news sources.

This is all Islam related, from the barbaric Ghesas laws to the segregated Islamic upbringings that isolates sexes from infants to elderly. Most moslem men lack social skills in dealing with opposite gender which is primarily because of their segregated upbringing. Had there been male-female socialization, this Islamic animal, Movahedi, would have been much better adjusted to a male-female relationship from a much younger age. Often times, these Islamic animals, in their adulthood, view women as their property and their blood boils over when the woman decides to dump the jerk. These are extensive problems in Islamic countries and most cases can be avoided by socializing male and females from early age. Let the nature take its course, don't separate!

All major world religion in general, Islam in particular, have been, and still are, dominated by men. Historically, they attend the mosques; they listen to, and often act upon, the exhortations of Mullahs and Sheikhs. All the Islamic reference books are written by men, all the religious leaders are men. Consequently all the rules are tilted toward men, who enjoy preferential treatments under Islamic rules. And, often these men have created travesties out of the privileges they have been provided by the Islamic laws. The kinds we see in many Moslem countries including in our own. Whatever is the justification, it doesn’t sound acceptable to people who live in modern democratic societies. It is not surprising that people in the west think that Islam is the religion of bunch of misogynists.

Ghessass is a very fair law. Actually, it is an excellent one because the victim decides what the kind of punishment the criminal should get. That is the fairest treatment of a crime. If someone does some wrong to me, I only want the same thing done to him or her. It seems that your intense hate for IRI has blinded your feeling for the pain a victim suffers. Have not you seen how easily criminals escape punishment in the west with its elaborate laws and judicial system?
