Two more juveniles to be executed on Wednesday

According to attorney Mohammad Mostafaei, juvenile offenders Amir Khaleghi and Safar Angooti are scheduled to be executed this Wednesday May 6th in Iran.

Stop Child Executions has been in contact with the office of the Special Rapporteur on extrajudicial, arbitrary or summary executions of the Office of the UN High Commissioner for Human Rights on Khaleghi's case over the last few months. They are well aware of his case and are taking action.

According to Mostafaei:

Amir Khaleghi was 16 years old, when he bought alcohol from a drug store, mixed it with orange juice and became drunk. He saw some friends hanging out on the street sidewalk close to a vendor and jokingly told the vendor not to sell anything to the other kids. A fight broke out, without premeditation, one of those involved in the fight Ali Malekpour was stiked in the chest and was killed. Amir Khaleghi does not remember how the incident happend. He says he wandered around until he was sober and felt very sad and remorseful for what had just taken place. He went to the city of Qom and later to Jamkaran where he turned himself into police. He explained his drinking matter and what he remembered of the incident. Branch 74 convicted him to "ghesas" (murder) which was confirmed in branch 27 of the Supreme Court.

His state appointed lawyer Mr. Sayed Ahmad Mobarragh worked hard to defend Amir, but his efforts were fruitless. According to Mr. Mostafaei, Amir was convicted despite the court taking into consideration that he was intoxicated, he was a juvenile offender and the fact that it is in breach of article 37 of the conventions that the council of experts had approved in oppostion to him being tried for "ghesas.

The head of Judiciary granted a two month stay of execution for Amir Khaleghi in February; however his execution is scheduled to take place in a couple of days.

Safar Angooti who was convicted of murder at age 17, is also scheduled to be executed this Wednesday after having spent a couple of years in prison.

According to Etemad daily on April 27th 2008, 17-year-old Safar Angooti stabbed a rival suitor who was talking to a girl he liked and was sentenced to death by a court in Tehran. He said "I have killed him but not intentionally. I did this because I was inexperienced and I was angry. I asked the family of the victim to forgive me but the victim's father said that I had killed his son Mehdi and deserve the punishment." The father of the deceased said "I don't know the reason why they got into a fight but Safar has killed my son and he should be killed".

Iran is a state party to the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18.

"We just lost Delara Darabi a few days ago, we don't want to lose anymore precious lives" said President of Stop Child Executions Nazanin Afshin-Jam. "How many more children have to be executed, in direct breach of the ICCPR and CRC before those responsible are held accountable?"

Islamic Scholars in Iran and around the world have no agreement on the subject and therefore many use 18 as the reference. 

However Islamic Republic Sharai laws consider puberty as the age of responsibility which translates to age of 9 for girls and 15 for boys. However they have even executed children younger than that.

I didn't say it depends on their moods.
I said it depends on the period. Like, when there are negotiations going on, they'll use these as tools for leverage. Or when they're under international political pressure they react differently to each case. That's what I meant.

I don't understand this, is this week a "kill A child Week'? What is the matter with these animals? Just because amoo Ombama said "eide shoma mubarak" means U.S. will ease off? and they can do whatever the hell they want? apparently, they are testing the world by killing our own people for whatever reason they feel like.

More importantly, the people inside Iran, are they scared as hell hearing about all these wave of executions,yet they won't raise a concern?

As Mr.Parham says, these faxes, emails etc may have different effect depending on their moods. We just have to hope that you catch them in good mood.

Naah, don't get scared. They won't even read what you sent. All that will matter is the fact that by the sheer number of letters and e-mails they'll receive, they'll know that the case is receiving attention and how much it is receiving it (and by what sources, but they won't even get that deep most of the time). That, actually, could work out in detriment of the case like it did in the case of Delara Darabi, and a lot of the times it works for the case -- again depending on what period of time the pressure is taking place.
For Ganji, the pressure that the pictures inside the jail created was what actually got him out, yet at the same time period, putting the IR under pressure for the release of Amad Batebi was working to his detriment, that's why his case had to wait and go low-key later.
It always depends on what's going on -- and who is using which case as what -- for example, again, Delara Darabi's case was too politicized (without wanting to get more into that). In the case of Mir-Sayyafi, my guess is he was the type that didn't give in very easily despite how the case was publicized to the contrary, and his death was more of a "nasagh-giri" for the other bloggers and bloggers-to-be, and all those who were thinking of putting on the international pressure for the bloggers collectively. Please remember that his death also came on "shabe eyd", meaning when it would have drawn minimum attention as everyone was in the holiday state of mind. But that only goes to show how much all the pressure is effective and how scared these guys actually are; meaning there is a positive side to it as far as the conclusions to be drawn.

In any case, they only go after cases where they think and know there is potential/fatal danger for them -- they don't have enough time and people to go after every "average Joe" that sends them an e-mail. The good thing is these last years because of the Internet, the number of people who voice their discontent directly has multiplied by a crazy amount, which makes it that they would never be able to control much.

I would say do be careful sometimes though (and if you want I could give you examples), but this is certainly not a case where you should be.

I'll also add that the above represents only my point of view.

AF and Abarmard:  I wrote it in English.  I don't have the keyboard capability for Farsi.  I was very respectful and pleaded with him to rise above and be humane.  He or his staff probably don't read any of this.  Sadly, I'm not sure they're even literate.  I haven't received any sort of reply but it took my American  Congressman 3 weeks to reply.  I think he's sick of hearing from me.  I'm a constant source of irritation for him.

kinda makes you wonder, doesn't it.  when aziz went back after 20 years, i was sleepless until i got that phone call telling me he was with family.  and it was worse when he left to come home.  not knowing if he was out OK or not.  but i don't think either one of us would deny that it was worth every fearful moment.

ps.  do ya think he might listen to an email from an american?  :-))

or maybe i should just leave well enough alone?

We have to agree that if the society was against the Juvenile prosecution, then the victims family would never allow the death penalty to take place. I believe we need to educate the society to stop child execution rather than the system, in this case.

unfurtunately ,when it comes to capital punishment "GHesas"there is very little  in the Islamic law judiciary or government or any one can do , main decision is totally in hand of " victims family" to decide , let go the convicts or not, I don't know if is good to have state would handle and to be in charge of convict fate(like many western country) ,  in that case I dont think there would be any chance for convict to get away from death at all, which in Iran in the past there has been the cases that victim family after much and long request eventuly agreed to take compassionate route , and let the person live, therefor, my suggestion(or many of us) is, it is worth to try, to introduce bank account, and try publicly raise money for victims family (regardless if they ask for it or not) and organize televised congregational pray for both victim and convect and creating a page on net for signing petition so they (GOD & victims family) can see how many million begging them to let go.than GOD MAY have change of heart and soften victim families heart so they MAY have change of heart and change their decision. otherwise  ,there is reason to believe opportunist literally wants  convict to lose their life and be executed so the can live and cash on their death, and fish against current regime . I ask for true compassionate and true forgiveness seeker lets try right action and find some trustee and volunteers possibly join religion(Muslim, christian, Jews, Zoroastrian,Bahai adherents "if they wish") committee, in Iran , open one special bank account and publicly ,showing statement on the net so any one around the world can see every minute how much has been raised , and how ever if victim family for any unfortunate reason decided not to take the money for any reason (is their right to not to), than, collected money + more get raised  should be offered for next young convict. I'm afraid that is all we can try and do other than that folks who say thing about how cruel regime is bla bla , and this sort of approach is useless and IS VERY CLEAR, they DO want these young convicts to be executed so these coward  opportunist can live on their blood for little while, AND most definitely they do not care about any young or old life all together all  they care is take advantage of such situation and since this suggestion would probably save some life and aiming and cutting opportunist(enemy of IRAN) fortune ,they are going to chase my tale and not going to like this post ,let see. (of course these cowards are very good of changing their identity and come with unknown names )GOD have a mercy on all of us.
