President Obama’s speech on national security last week in which he promoted a plan of preventive detention for some Guantanamo detainees raised many constitutional concerns.

And while I’ve been trying to decide whether or not I was surprised by the content of his speech, his overall message was similar to something we would hear from the Bush administration.

In his speech, while detailing aspects of national security, Obama spoke on the task of eventually closing down the prison at Guantanamo and what measures need to be taken to determine the future of the detainees held there.

“Now, finally, there remains the question of detainees at Guantanamo who cannot be prosecuted, yet who pose a clear danger to the American people,” Obama said. “And I have to be honest here – this is the toughest single issue that we will face. We’re going to exhaust every avenue that we have to prosecute those at Guantanamo who pose a danger to our country.

“But even when this process is complete, there may be a number of people who cannot be prosecuted for past crimes, in some cases because evidence may be tainted, but who nonetheless pose a threat to the security of the United States.”

Let's review, shall we?

1) The 8th Amendment does not apply in the case of acts of war. The 8th Amendment applies in matters of civil law.

2) The 7th Amendment, like the first, applies in matters of civil law. It does not apply to combatants in a military conflict.

3) 6th Amendment? The Abu Ghraib matter has in fact been adjudicated some time ago. The parties found to be responsible were charged, tried, convicted, and are serving their sentences.

4) 4th Amendment? That's not applicable to the incidents to which you refer. A touchy subject to be sure, but not a 4th Amendment issue.

5) 2nd Amendment? From one NRA member to another, I support it all the way. What I don't support are the laws that make it more difficult for me to purchase a firearm, while any thug can get one in 10 minutes on any street corner.

6) Bill of rights? Believe it or not, we're in greater danger than ever of having those rights changed. Examples include the atmosphere surrounding the nomination of Sonia Sotomayor to the Supeme Court. People are being admonished for voicing any objection over her nomination.

Another example is the government takeover of both GM and Chrysler. Creditors who initially refused to accept what they felt were unfair concessions have actually been threatened by goverment officials and coerced into ultimately accepting them. For example, one woman who is a GM bondholder, has seen her $70,000.00 GM bond portfolio (the amount she invested originally) exchanged for GM stock, which, as of the bankruptcy filing, was worth less than $200.00. Her right to protest was taken away.

Hey thanks Kaveeh , good advise I went and read the bill of right again :

Eighth Amendment : – Prohibition of excessive bail and cruel and unusual punishment.
water boarding , CIA'S Rendition, Abu Ghraib ? Is any of them bring the bell ?

Seventh Amendment – Civil trial by jury.
Where is jury on guantanamo ?
Where is jury in Afghanistan and Iraq ?

Sixth Amendment – Trial by jury and rights of the accused; Confrontation Clause, speedy trial, public trial, right to counsel
And we have abu Ghraib and rendition and guantanamo , were this right granted ?

Fourth Amendment – Protection from unreasonable search and seizure.
US GOV have been cut Eavesdropping on American phone line and controlling online activity

Second Amendment – Militia (United States), Sovereign state, Right to keep and bear arms.
This is where NRA come from but still they are danger of losing it any time .

First Amendment – Establishment Clause, Free Exercise Clause; freedom of speech, of the press, Freedom of Religion, and of assembly; right to petition,
The quick look at history of anarchist and protesters in usa shows how safe they are from the gov.
But that’s not a problem yet for obama’s adm.

So this was bill of right . Part of them .

Obama is a systematic thinker who has short, medium and long term plans. Obama's first priority is the economy, period. There's no way in heck that Obama could do things like, "...end the war in middle east and ... persecute bush's adm for their war crimes", or take up hot-button topics like gary marriage and his "closeness" to the Wall Street atfter being only six months in office. Those comments makes you a liberal, my friend, not that there's anything wrong with that.

Obama's job number one is the economy right now. The US has proved to the world that it can change what, Obama called during the campaign, to change the "trajectory of the US policies". That means, by and large, we have to deal with the past and existing policies while the policy directions are changing. But that change is not going to happen in such a short time.  I hope you do appreciate the complexity and importance of bringing peace to the ME. I'm willing to waint and judge Obama in a year or so. It's too soon to judge Obama right now.

Furthermore, Bush didn’t commit war crimes, and no one has the right or will for that matter to end the Afghanistan war, which was supported by the world, until Afghanistan is secured. In addition, since you’re pro Fascism and wanting government to control your life, no central government has the right to determine things like gay marriage, Bush didn’t impose nor should Obama, and he will not because America’s democracy is always one step ahead of the world. And your other mumbo jumbo about aiding the rich not the poor and wall street crap is absolutely untrue and made up BS from your confused socialist mind.

Although I would not go as far as the article or the headline by Kashani suggests, But as an avid supporter of Obama, and a registered Dem. who happens to be member of NRA as well, I have few disappointments regarding the early policies of Mr. Obama. I have registered my complaints with the  moveon.or as well. Exercising my constitutional right I suppose.

My biggest disappointment has been so far about foreign policies, particularly ME, war in Iraq, Afghanistan, Pakistan, and who knows God forbid may be war in Iran.  >:-|

I wanted Republicans out of the white house real real bad, and I have full confidence in Mr. Obama's Administration. He just needs to watch his back in regards to lobby groups and their agenda.
